Membership Contract

Contract for Membership in Flamingo Transport Company

Flamingo Transport Company (hereafter referred to as "The Company") agrees to provide transportation to the undersigned client for one year from date noted below. All travel is by reservation. The Company will dispatch a passenger vehicle and driver to the client's home and transport the client to a pre-arranged destination. Also by pre- arrangement, the driver will return to transport the client home or to another location as per the client's trip reservation request. Payment for trip fee will be withdraw n from client's payment account.

Membership may be used for a single individual, a couple, or an individual with a traveling companion. Conversion vehicle can carry one wheelchair at a time. Client using the conversion vehicle may choose to remain in their personal chair or transfer to vehicle seating upfront next to the driver. Conversion vehicle is equipped to secure both chair and rider. If client remains in his or her personal chair, a spouse or companion may use the front passenger seat. Other vehicles can accommodate a party of four.

"Trip" is defined as one pickup/delivery. Client may reserve multiple trip stops. Ex: Trip #1: Pick up and drop off at supermarket. Trip #2: Pick up at supermarket and take to shoe store. Trip #3: Pick up at shoe store and return home. Three trips are reserved in total. Each leg of the trip will incur a trip charge. "Round Trip" means to be picked up from home, taken to one location, picked up again and returned home. The services of Flamingo Transport Company are designed to assist those persons who are otherwise unable to drive themselves to typical appointments, errands, and social events. It is capable of providing transportation daily to work for those in the workforce. However the services are shared with other clients. If your schedule requires multiple stops several or each day of the week, Flamingo Transport will be unable to accommodate you. The Company reserves the right to limit travel reservations from one client that appear to the company to be excessive. Please advice the office of your scheduling needs before signing on with Flamingo Transport Company so there is a clear understanding for both parties of the extent of client's travel needs.

Reservations must be made in advance for all travel a minimum of 48 hours in advance Reservations may be requested by phone, mail, or Internet. All reservations are confirmed by phone only. Once a reservation is confirmed the client is assured travel for the requested day and time. Reservation requests are confirmed during office hours only. "Office hours" are defined as Monday through Friday, 9:00 AM to 5:00 PM excluding holidays. Requests for reservations made after office hours are not confirmed just by virtue of meeting the required 48-hour notice clause, they still must be confirmed by phone. If you need a reservation for Monday you should notify the office no later than Thursday the week before.

Reservations for daily or regularly needed trips may be made for the year in advance. Any change in the day or time must be made at minimum 48 hours in advance. Every effort will be made to accommodate client's requests in terms of days and time service is needed. Early reservation requests secure your day and time. Occasions may arise that the client's needs cannot be met in the manner requested. For short notice request please be prepared to adjust your pickup time.

The boundaries of travel are within Brevard County, FL. Specifically on the mainland, Grant Road, Palm Bay to the south, Route 528 to the north, Atlantic Ocean to the east and the St. John's River to the west. On the Barrier Island the boundaries are Route 528 in the north and Melbourne Beach's southern boundary. Operating license for Company restricts travel to Brevard County.

Driver will report to client's door on arrival. Driver will assist client from door of residence, to and into vehicle. Driver will assist client in exiting vehicle and will accompany client to door of destination building. Further assistance for clients with special needs must be pre-arranged with The Company. Driver will not stay with client after delivery to destination. Driver will return to the location client was dropped off at for return trip. Driver will assist client with carrying packages from vehicle to inside client's door. "Packages" are defined as shopping bags and small boxes. Driver will not make any unreserved stops for client while in route to destinations. Driver is not permitted to accept gratuities from clients.

The driving schedule is designed to allow time for embarking and disembarking the vehicle. Please be respectful of this and be on time for your vehicle. Drivers who experience delays for one client risk further delays for remaining clients on the schedule. Excessive tardiness will result in termination of contract by The Company. The Company reserves the right to determine "excessive tardiness". Money paid for time remaining on contract will be refunded in the manner in which it was first paid.

On occasion it will be necessary to cancel a reserved trip. This is often due to illness or weather. If you have a foul weather standby for your reserved trip (say a rained out pool trip will become a bowling trip instead) put this information in the trip notes section or tell the office when you make your reservation. Clients have one free trip cancellation per month if made no later than two hours before the driver arrives. All trips cancelled when the driver arrives will be accessed a one-way trip fee. After the first free trip cancellation is used trips cancelled within 24 hours of the scheduled trip will be accessed a fee equal to a one trip charge as defined by your membership type.

Membership is $500.00 for one year. Each trip made will cost $3.00. Round trip fee is $6.00. Travel distance for a one-way trip is up to 15 miles from the starting point (point A to point B). Any trip longer than 15 miles will have a surcharge of $8.00 each way. Payment for each trip must be in client's account prior to usage. Specifically client's account with Flamingo Transport Company must contain $6.00 minimum on day of trip. Payment may be made with a personal check (mailed and received in office prior to use) or by a small amount kept in account and deducted as trips are made or by credit card. Credit card will not be billed until the end of the month for the total amount of trips taken during that month. No balance is required to be kept in the account. No money or checks are to be given to the driver.

"Try before you buy" is not a membership. It is a 30 day period in which a client (or couple or individual with companion) can use Flamingo Transport Company for travel within the above named boundaries for a fee of $25.00 round trips only. Reservations must be made at least 48 hours in advance as per the above stated reservation request paragraph. Payment must be made in advance by credit card or check. After thirty days of use, if the client chooses to join Flamingo Transport Company, the trip cost overage will be deducted from the membership. Example: the client takes 5 trips at $25.00 each then decides to become a member. $19.00 from each trip is deducted from the membership bringing the membership cost down to $405.00.

Refund policy for yearly membership is as follows:

  • All refunds will be issued in the manner in which the client originally purchased the membership.
  • All refund requests must be made in writing with the exception of a request made within three days of purchase.
  • Request for a refund may be made within three days of purchase by phone, email, or mail and will be refunded in full in the manner in which it was purchased.
  • All other requests will be refunded within 30 days of receipt of request.
  • Refund amount will be tallied as 1/12 of the membership fee multiplied by the number of months left in the membership period.
  • For the membership purchased and never used, a full refund will be issued in the manner in which it was purchased.
  • Gift membership refund requests must come from the person who purchased the gift. Refund will be sent to the purchasing individual not the gift recipient.

Travel by passenger vehicle has an inherent risk associated with it due to circumstances that can arise beyond the control of the driver, the Company, and the safety features in said vehicle. The vehicles of the Company are insured in accordance with state law and the drivers are licensed in accordance with state law. However, there is no guarantee that these important measures can protect the client from harm's way. Flamingo Transport Company pledges to provide the safest ride for our clients to the best of our ability. Our client's must accept this is not risk free and there is an unforeseeable danger to them.
